1. BÊN KIỂM SOÁT VÀ XỬ LÝ DỮ LIỆU CÁ NHÂN/PERSONAL DATA CONTROLLER AND PROCESSOR
1.1. Bên Kiểm Soát và Xử Lý Dữ Liệu Cá Nhân là Công Ty TNHH Savills (Việt Nam), mã số doanh nghiệp 0100777512, được cấp giấy chứng nhận đăng ký doanh nghiệp lần đầu bởi Sở Kế Hoạch và Đầu Tư Thành Phố Hà Nội ngày 01/10/2007 (bao gồm tất cả chi nhánh, địa điểm kinh doanh, văn phòng đại diện, và đơn vị phụ thuộc/ trực thuộc khác tùy từng thời điểm, nếu có) (“Savills”)./Personal Data Controller and Processor is Savills Vietnam Co., Ltd, with business registration of 0100777512, issued first time by Department of Planning and Investment of Hanoi City, on date 01 October 2007 (including its branches, business units, representative offices, and others affiliates from time to time, if any) (“Savills”).
1.2. Savills được toàn quyền tiến hành bất kỳ hoặc tất cả các hoạt động/ hành vi tác động tới Dữ Liệu Cá Nhân (gọi chung là “Xử Lý Dữ Liệu Cá Nhân”), mà ứng viên/ người lao động đã cung cấp và/hoặc Savills đã thu thập được theo các cách thức và mục đích cụ thể được nêu rõ trong Thông Báo này. Việc Xử Lý Dữ Liệu Cá Nhân có thể được thực hiện một phần và/hoặc toàn bộ tại (các) vùng tài phán khác nhau (bao gồm nhưng không giới hạn ở Việt Nam)./Savills reserves the right to conduct any or all activities/ behaviors affecting the Personal Data (hereinafter referred to as “Personal Data Processing”), which you provide and/or Savills collect in accordance with the method and purpose set forth in this Notice. The Personal Data Processing may be conducted in whole and/or in part in any jurisdiction(s) (including but not limited to Vietnam).
2. DỮ LIỆU CÁ NHÂN ĐƯỢC THU THẬP/PERSONAL DATA TO BE COLLECTED
2.1. Trong quá trình tuyển dụng và/hoặc thời gian làm việc của ứng viên và/hoặc người lao động, Savills có thể thu thập Dữ Liệu Cá Nhân thông qua các tương tác trực tiếp và/hoặc gián tiếp giữa Savills và ứng viên/ người lao động dưới bất kỳ hình thức nào, bao gồm nhưng không giới hạn ở việc (i) ký/ nộp thỏa thuận, hợp đồng, văn bản cung cấp thông tin (như đơn ứng tuyển, sơ yếu lý lịch, hồ sơ sức khỏe .v.v…), (ii) ghi nhận hình ảnh cá nhân bằng máy quay giám sát/ hệ thống camera an ninh trong quá trình tuyển dụng và/hoặc thời gian làm việc, (iii) truy cập website, ứng dụng, phần mềm của hoặc quản lý/ vận hành bởi Savills/ Savills Group (bao gồm cả việc sử dụng các cookie để tự động thu thập một số thông tin từ thiết bị của ứng viên/ người lao động – để biết chi tiết về cách sử dụng Cookie của Savills, ứng viên/ người lao động có thể xem quy định tương ứng về Cookie tại đường link “https://vn.savills.com.vn/footer/privacy-policy.aspx”), và/hoặc (iv) được cung cấp bởi đại diện của ứng viên/ người lao động./During your recruitment process and/or employment period, Savills may collect Personal Data through direct and/or indirect interactions with you under any measures, including but not limited to (i) signing/ submitting the agreements, contracts, informative documents (such as job application, curriculum vitae, health record, etc.), (ii), recording the personal image by security camera system/ closed-circuit television during the recruitment process and/or employment period, (iii) accessing websites, applications, software of Savills/ Savills Group or being controlled/operated by Savills/ Savills Group (including usage of Cookie to automatically collect certain information from your devices – for details of Cookie’s usage, you may see the Cookie provisions at this link “https://vn.savills.com.vn/footer/privacy-policy.aspx”), and/or (iv) being provided by your representatives.
2.2. Tương ứng với Điều 2.1 nêu trên, Dữ Liệu Cá Nhân được thu thập bởi Savills bao gồm nhưng không giới hạn ở:/According to Article 2.1 above, the Personal Data Protection to be collected by Savills including but not limited to:
a) Dữ Liệu Cá Nhân Cơ Bản: họ, chữ đệm và tên khai sinh, tên gọi khác (nếu có); ngày, tháng, năm sinh; ngày, tháng, năm chết hoặc mất tích; giới tính; nơi sinh, nơi đăng ký khai sinh, nơi thường trú, nơi tạm trú, nơi ở hiện tại, quê quán, địa chỉ liên hệ; quốc tịch; hình ảnh của cá nhân (bao gồm cả hình ảnh, thông tin có được từ các hệ thống camera an ninh); số điện thoại, số chứng minh nhân dân, số định danh cá nhân, số hộ chiếu, số giấy phép lái xe, số biển số xe, số mã số thuế cá nhân, số bảo hiểm xã hội, số thẻ bảo hiểm y tế; tình trạng hôn nhân; thông tin về mối quan hệ gia đình (cha mẹ, con cái); thông tin về tài khoản số của cá nhân; dữ liệu cá nhân phản ánh hoạt động, lịch sử hoạt động trên không gian mạng; các thông tin khác gắn liền với ứng viên/ người lao động hoặc giúp xác định ứng viên/ người lao động không thuộc dữ liệu cá nhân nhạy cảm theo điểm (b) dưới đây./Basic Personal Data: last name, middle name, birth name, other name (if any); date of birth; date of dead or missing; gender; place of birth, place of birth registration, place of permanent residence, place of temporary residence, current residence, hometown, contact address; nationality; images of individuals (including images, information obtained from security camera system); phone number, identity card number, personal identification number, passport number, driver’s license number, license plate number, personal tax code, social insurance number, health insurance card number; marital status; information about family relationships (parent, children) ; information about individual’s digital account; personal data reflecting activities, history of activities on cyberspace; other information that pertains to you or support to identify you but not considered as sensitive personal data as in point (b) hereunder.
b) Dữ Liệu Cá Nhân Nhạy Cảm: quan điểm chính trị, quan điểm tôn giáo; tình trạng sức khỏe và đời tư được ghi trong hồ sơ bệnh án, không bao gồm thông tin về nhóm máu; thông tin liên quan đến nguồn gốc chủng tộc, nguồn gốc dân tộc; thông tin về đặc điểm di truyền được thừa hưởng hoặc có được của cá nhân; thông tin về thuộc tính vật lý, đặc điểm sinh học riêng của cá nhân; thông tin về đời sống tình dục, xu hướng tình dục của cá nhân; dữ liệu về tội phạm, hành vi phạm tội được thu thập, lưu trữ bởi các cơ quan thực thi pháp luật; thông tin khách hàng của tổ chức tín dụng, chi nhánh ngân hàng nước ngoài, tổ chức cung ứng dịch vụ trung gian thanh toán, các tổ chức được phép khác, gồm: thông tin định danh khách hàng theo quy định của pháp luật, thông tin về tài khoản, thông tin về tiền gửi, thông tin về tài sản gửi, thông tin về giao dịch, thông tin về tổ chức, cá nhân là bên bảo đảm tại tổ chức tín dụng, chi nhánh ngân hàng, tổ chức cung ứng dịch vụ trung gian thanh toán; dữ liệu về vị trí của cá nhân được xác định qua dịch vụ định vị; dữ liệu cá nhân khác được pháp luật quy định là đặc thù và cần có biện pháp bảo mật cần thiết./Sensitive Personal Data: political opinions, religious opinions, status of health and private life in the medical record, excluding information of blood type; information related to racial or ethnic origin; information about an individual’s genetic traits inherited or acquired; information about an individual’s physical attributes and biological characteristics; information about an individual’s sex life and sexual orientation; data on crimes, criminal acts collect and stored by law enforcement agencies; customer information of credit institutions, foreign bank branches, payment intermediary service providers, and other authorized organizations, including: customer identification information as prescribed by the laws, information on accounts, deposits, deposited assets, transactions, organizations and individuals being the guarantors at credit institutions, bank branches, payment intermediary service providers; data of individual’s location identified through location services; other personal data, which is stipulated by the laws, is specific and required the necessary security measures.
2.3. Trong trường hợp ứng viên/ người lao động không phải là Chủ Thể Dữ Liệu, ứng viên/ người lao động khẳng định và cam kết có đầy đủ thẩm quyền và sự đồng ý tương ứng của Chủ Thể Dữ Liệu và/hoặc người đại diện, giám hộ hợp pháp của Chủ Thể Dữ Liệu (“Đại Diện Chủ Thể Dữ Liệu”) theo quy định của pháp luật để cung cấp Dữ Liệu Cá Nhân của Chủ Thể Dữ Liệu cho Savills./In event that you are not Data Subject, you represent and warrant that you have full authority and corresponding consent of the Data Subject and/or its legal representative, guardian of the Data Subject (“Data Subject Representative”) as required by the laws to provide the Data Subject’s Personal Data to Savills.
3. MỤC ĐÍCH XỬ LÝ DỮ LIỆU CÁ NHÂN/PURPOSE OF PERSONAL DATA PROCESSING
3.1 Savills có thể xử lý Dữ Liệu Cá Nhân của ứng viên/ người lao động cho các mục đích sau, bao gồm nhưng không giới hạn:/Savills may process your Personal Data for the following purposes, including but not limited to:
a) Xác định danh tính đối tượng ứng tuyển và/hoặc làm việc;/Identifying the subject for the recruitment and/or employment;
b) Liên lạc và/hoặc gửi đến ứng viên/ người lao động, Chủ Thể Dữ Liệu, và/hoặc Đại Diện Chủ Thể Dữ Liệu, bằng các phương thức phù hợp với quy định của pháp luật, các thông báo, cập nhật, tài liệu, liên quan đến và/hoặc phát sinh từ việc tuyển dụng và/hoặc làm việc;/Communicating and/or sending to you, the Data Subject and/or the Data Subject Representative, by methods in accordance with the laws, the notices, updates, document related to and/or arising from the recruitment and/or employment;
c) Thực hiện các hành vi, hoạt động/ thủ tục cần thiết liên quan đến và/hoặc phát sinh từ quá trình làm việc tại Savills (như thanh toán tiền lương, đào tạo, kiểm tra sức khỏe, .v.v…, nếu có, theo quy định nội bộ của Savills);/Conducting necessary actions/ procedures related to and/or arising from the employment period at Savills (such as salary payment, training, health checking, etc., if any, in accordance with the internal rules of Savills);
d) Thực hiện các hành vi pháp lý/ thủ tục tố tụng cần thiết để bảo vệ quyền và lợi ích hợp pháp của Savills theo quy định của pháp luật;/Conducting necessary legal actions/ procedures to protect Savills’ legitimate rights and interests in accordance with the laws;
e) Thực hiện các nghĩa vụ đối với cơ quan Nhà nước theo quy định của pháp luật./Conducting other obligations towards the State bodies in accordance with the laws.
4. THÔNG BÁO TUYỂN DỤNG/RECRUITMENT NOTICE
4.1. Căn cứ mục đích Xử Lý Dữ Liệu Cá Nhân nêu trong Thông Báo này, Savills có thể cung cấp cho ứng viên/ người lao động các thông tin liên quan đến các cơ hội việc làm khác tại Savills mà ứng viên/ người lao động có thể quan tâm, bằng cách gửi thư điện tử, gọi điện thoại, gửi tin nhắn SMS, sử dụng ứng dụng OTT/ mạng xã hội (và/hoặc các hình thức hợp pháp khác), với tầng suất phù hợp với quy định của pháp luật (“Thông Báo Tuyển Dụng”)./According to purpose of the Personal Data Processing herein, Savills may provide you with the information regarding other recruitment opportunities of Savills that you may be interested in, by sending emails, making the phone calls, sending the SMS message, using OTT applications/ social network (and/or other legitimate methods), with the frequencies in accordance with the laws (“Recruitment Notice”).
4.2. Trong trường hợp ứng viên/ người lao động không muốn tiếp tục nhận Thông Báo Tuyển Dụng, ứng viên/ người lao động có thể hủy đăng ký nhận Thông Báo Tuyển Dụng theo hướng dẫn chi tiết được đính kèm trong mỗi Thông Báo Tuyển Dụng đó./If you do not wish to continue receiving the Recruitment Notice, you may unsubscribe from receiving the Recruitment Notice following the detailed instructions in the Recruitment Notice.
5. HẬU QUẢ KHÔNG MONG MUỐN CÓ THỂ XẢY RA/UNDESIRABLE RESULT THAT COULD OCCUR
5.1. Xử Lý Dữ Liệu Cá Nhân là rất cần thiết cho quá trình tuyển dụng và làm việc, và Dữ Liệu Cá Nhân sẽ không được xử lý nếu không có được sự chấp thuận tương ứng của Chủ Thể Dữ Liệu và/hoặc Đại Diện Chủ Thể Dữ Liệu. Do đó, Savills sẽ không chịu trách nhiệm trong trường hợp quá trình tuyển dụng và/hoặc làm việc bị gián đoạn hoặc không toàn vẹn do không thể Xử Lý Dữ Liệu Cá Nhân vì không có sự chấp thuận/ đồng ý tương ứng của ứng viên/ người lao động (hoặc sự chấp thuận/ đồng ý đó bị ứng viên/ người lao động rút lại)./Personal Data Processing is essential to the recruitment and employment, and the Personal Data will not be processed without the respective consent of the Data Subject and/or the Data Subject Representative. Therefore, Savills will not be responsible in the event that the recruitment and/or employment is interrupted or incomplete because of your respective non-consent to that Personal Data Processing (or the consent is withdrawn by you later).
5.2. Để bảo vệ Dữ liệu Cá nhân khỏi bị truy cập, thu thập, sử dụng, tiết lộ, sao chép, sửa đổi, xử lý trái phép hoặc các rủi ro tương tự, Savills đã và sẽ áp dụng các biện pháp quản lý và kỹ thuật phù hợp. Tuy nhiên, ứng viên/ người lao động hiểu rằng không có phương thức bảo vệ nào là an toàn tuyệt đối, do đó, Savills sẽ cố gắng tối đa trong việc bảo vệ Dữ Liệu Cá Nhân, nhưng không thể cam kết an toàn tuyệt đối cho Dữ Liệu Cá Nhân./To protect Personal Data from unauthorized access, collection, use, disclosure, copying, modification, processing or other similarities, Savills has and will apply appropriate technical and management measures. However, you understand that no protection measure is absolutely safe, hence, Savills will try its best to protect the Personal Data but cannot guarantee absolute security for the Personal Data.
6. CUNG CẤP, CHUYỂN GIAO DỮ LIỆU CÁ NHÂN/PROVISION, TRANSFER OF PERSONAL DATA
6.1. Cho mục đích Xử Lý Dữ Liệu theo Thông Báo này, Savills có quyền:/For the purpose of the Personal Data Processing in this Notice, Savills reserves the rights to:
a) chia sẻ, cung cấp Dữ Liệu Cá Nhân cho các công ty liên kết/ thành viên, công ty con, công ty mẹ của Savills, và/ hoặc các công ty/ tổ chức khác có mối quan hệ (trực tiếp hoặc gián tiếp) với những công ty này hoặc Savills thông qua sở hữu cổ phần, phần vốn góp, hoặc các hình thức kiểm soát khác (dù ở trong hoặc ngoài lãnh thổ Nước Cộng Hòa Xã Hội Chủ Nghĩa Việt Nam) (“Savills Group”);/Share, provide the Personal Data to affiliates/ members, subsidiaries, parent company of Savills, and/or other companies/ organizations having (direct or indirect) relationships with these companies or Savills through share ownership, capital contribution, or other controlling manners (whether inside or outside the territory of the Socialist Republic of Vietnam) (“Savills Group”);
b) chia sẻ, cung cấp Dữ Liệu Cá Nhân cho các bên thứ ba liên quan đến và/hoặc hỗ trợ quá trình tuyển dụng và/hoặc làm việc một cách trực tiếp và/hoặc gián tiếp, bao gồm nhưng không giới hạn ở các bên tư vấn chuyên môn (như kiểm toán, luật sư, .v.v…), cơ quan nhà nước có thẩm quyền, cơ quan/ đơn vị giải quyết tranh chấp, các đại lý/ đối tác/ nhà thầu khác có liên quan (như công ty tuyển dụng, công ty đào tạo/ du lịch, cơ sở y tế, .v.v…)./Share, provide the Personal Data to third parties in connection with and/or assist in the recruitment and/or employment directly or indirectly, including but not limited to professional consultants (such as auditors, lawyers, etc.), competent State agencies, dispute settlement agencies/ units, other relevant agents/ partners/ vendors (such as recruitment companies, training/ travelling companies, health facilities, etc.).
7. QUYỀN VÀ NGHĨA VỤ CỦA ỨNG VIÊN/ NGƯỜI LAO ĐỘNG LIÊN QUAN ĐẾN DỮ LIỆU CÁ NHÂN/YOUR RIGHTS AND OBLIGATIONS RELATED TO THE PERSONAL DATA
7.1. Ứng viên/ người lao động, với tư cách là Chủ Thể Dữ Liệu, có những quyền liên quan đến Dữ Liệu Cá Nhân của mình theo quy định của pháp luật về bảo vệ dữ liệu cá nhân (gồm quyền được biết, quyền đồng ý, quyền truy cập, quyền rút lại sự đồng ý, quyền xóa dữ liệu, quyền hạn chế xử lý dữ liệu, quyền cung cấp dữ liệu, quyền phản đối xử lý dữ liệu, quyền khiếu nại/ tố cáo/ khởi kiện, quyền yêu cầu bồi thường thiệt hại, quyền tự bảo vệ, và các quyền khác, nếu có)./You, as Data Subject, have the rights related to your Personal Data in accordance with the regulations on personal data protection (including the right to know, the right to consent, the right to access, the right to withdraw consent, the right to delete data, the right to restrict data processing, the right to provide data, the right to object to data processing, the right to complain / denounce / sue, the right to claim damages, the right to self-defense, and other rights, if any).
7.2. Ứng viên/ người lao động có những nghĩa vụ sau với tư cách là Chủ Thể Dữ Liệu:/You have the following obligations as Data Subject:
a) Tự bảo vệ Dữ Liệu Cá Nhân của mình; yêu cầu các tổ chức, cá nhân khác có liên quan bảo vệ Dữ Liệu Cá Nhân của mình;/Self-protect your Personal Data; request other relevant organizations and individuals to protect your Personal Data;
b) Tôn trọng, bảo vệ Dữ Liệu Cá Nhân của người khác;/Respect and protect the Personal Data of others;
c) Cung cấp đầy đủ, chính xác Dữ Liệu Cá Nhân khi đồng ý cho phép Xử Lý Dữ Liệu Cá Nhân;/Provide complete and accurate Personal Data upon giving allowance of the Personal Data Processing;
d) Tham gia tuyên truyền, phổ biến kỹ năng bảo vệ Dữ Liệu Cá Nhân;/Participate in propaganda and dissemination of Personal Data protection skills;
e) Thực hiện quy định của pháp luật về bảo vệ Dữ Liệu Cá Nhân và tham gia phòng, chống các hành vi vi phạm quy định về bảo vệ Dữ Liệu Cá Nhân;/Comply with the regulations on Personal Data protection and participate in the prevention of violations of regulations on the Personal Data;
f) Các nghĩa vụ khác theo quy định của pháp luật./Other obligations under the laws.
8. THỜI GIAN XỬ LÝ DỮ LIỆU/PROCESSING PERIOD
8.1. Savills bắt đầu Xử Lý Dữ Liệu Cá Nhân khi nhận được sự đồng ý của ứng viên/ người lao động./Savills commences the Personal Data Processing upon receiving your respective consent.
8.2. Savills lưu trữ Dữ Liệu Cá Nhân trong khoảng thời gian cần thiết để hoàn thành các mục đích được nêu trong Thông Báo này, trừ khi thời gian lưu trữ Dữ Liệu Cá Nhân lâu hơn được yêu cầu hoặc cho phép bởi các quy định pháp luật hiện hành./Savills stores Personal Data for the necessary period to fulfill the purposes set forth in this Notice, unless a longer retention period of Personal Data is required or permitted by the laws.
9. CẬP NHẬT, ĐIỀU CHỈNH THÔNG BÁO/UPDATE, ADJUSTMENT TO THE NOTICE
9.1. Savills có quyền thay đổi, cập nhật, điều chỉnh bất kỳ nội dung nào trong Thông Báo này vào bất kỳ thời điểm nào./Savills reserves the right to amend, update, adjust any content in this Notice at any time.
9.2. Thông báo về việc thay đổi, cập nhật, điều chỉnh nêu trên (“Thông Báo Thay Đổi”) sẽ được gửi cho ứng viên/ người lao động trước ngày (những) thay đổi này có hiệu lực./Notice of the above change, update, or adjustment (“Notice of Change”) will be sent to you before the effective date of such changes.
10. CƠ CHẾ PHẢN HỒI VÀ KHIẾU NẠI/FEEDBACK AND COPLAINTS MECHANISM
Ứng viên/ người lao động, với tư cách là Chủ Thể Dữ Liệu, có thể gửi yêu cầu thực hiện quyền của mình cho Savills thông qua địa chỉ thư điện tử info@savills.com.vn. Theo đó, Savills sẽ nhanh chóng rà soát và thực hiện yêu cầu hợp lệ của ứng viên/ người lao động phù hợp với quy định của pháp luật./You, as Data Subject, may submit a request to exercise your rights to Savills via email info@savills.com.vn. Accordingly, Savills will promptly review and implement your valid request in accordance with the laws.
Tôi, người ký tên dưới đây, đã đọc kỹ, hiểu rõ và tự nguyện đồng ý với toàn bộ nội dung Thông Báo này của Savills./I, the undersigned, have carefully read, understood, and voluntarily agree to the entire content of this Notice of Savills.
